Terms and Conditions
Purpose of Rental
Villa Serenity is to be used exclusively for private vacation purposes. Any commercial or other use is excluded. Villa Serenity can accommodate up to 9 adults, with 4 double rooms and 1 single room. Additionally, 3 children’s beds (65 cm x 165 cm) are available for the villa.
Contract Conclusion
The tenant confirms by signing that they are legally capable according to the laws of their country of residence and at least 18 years old, and can enter into legally binding contracts. The tenant acknowledges that Villa Serenity may only be occupied by the person named in the contract. Subletting, assignment of the lease, or allowing others not named in the contract to use the property is prohibited.
Payment Terms
Deposit, final payment, and any security deposit are outlined in the contract. The contract between the tenant and the landlord is concluded when the signed contract from the tenant has been received by the landlord. If the signed contract does not reach the landlord by the agreed date, the landlord may, without further notice and without liability for compensation, rent the property to someone else. If the deposit, final payment, and/or security deposit do not reach the landlord by the agreed date, the landlord may, after a short grace period of 3 days, rent the property to someone else without liability for compensation; however, the landlord may also insist on contract performance. All payments are to be made in Swiss Francs (CHF).
A deposit of 50% of the rental price is required upon signing the contract. The due date for the final payment will be specified by the landlord in the rental agreement. For last-minute bookings or payments via PayPal, the full amount is due. In case of delayed or incomplete payment, the landlord may cancel the booked rental period at the tenant’s expense and claim the corresponding cancellation fee as specified in clause 7.
Additional Costs
Additional costs such as electricity, gas, heating, etc., are included in the rental price unless explicitly stated otherwise in the contract. Additional costs not included in the rental price will be settled with the security deposit at the end of the rental period. This particularly applies to additional services booked.
Security Deposit
The tenant must provide a security deposit as specified in the contract. The deposit covers additional costs and damages/claims for damages. These costs will be settled upon termination of the rental agreement. If, at that time, the amount to be covered by the deposit is not yet determinable or if the tenant refuses to pay it, the landlord or the keyholder on behalf of the landlord may retain the deposit or part of it.
In such a case, the landlord will issue a statement to the tenant as soon as the amount is definitively determined and return any remaining balance to the tenant, with the cost of the transfer borne by the tenant. Any amount due to the landlord must be paid within 10 days of receipt of the statement. The landlord’s claim is not limited to the amount of the deposit.
Arrival, Handover of Villa Serenity, Complaints
The rental property will be handed over to the tenant in a clean and contractual condition. Should there be any defects or incomplete inventory at the handover, the tenant must immediately notify the landlord. Otherwise, it will be assumed that the rental property was handed over in proper condition.
If the tenant fails to take over the property on time or does not take it over at all, the entire rental price remains owed. The tenant is responsible for timely arrival. Any obstacles to arrival such as traffic congestion or canceled flights are the tenant’s responsibility. For arrivals from abroad, the tenant should independently check the entry requirements for Switzerland in advance.
The landlord is entitled to request an ID from individuals to verify their identity. Persons not named in the rental contract may be removed from the property. The rental fee remains fully owed.
Cancellation and Early Return of the Rental Property
In the event of official travel bans or quarantine, the booked rental can be canceled free of charge up to the day before the rental period begins.
The tenant may withdraw from the contract at any time under the following conditions:

From the written booking confirmation until 60 days before the start of the rental: no compensation.

60 to 43 days before the start of the rental: 30% of the final price.

42 to 30 days before the start of the rental: 50% of the final price.

29 to 10 days before the start of the rental: 80% of the final price.

Less than 10 days before the start of the rental: 100% of the final price.
The cancellation fee is based on the receipt of the written notice by the landlord during normal office hours between 09:00 and 17:00. Notices received on Saturdays, Sundays, and public holidays will be considered received on the next working day. The holiday regulations and time zone of the landlord's location are applicable. This applies to notifications by email, SMS, internet, fax, or voicemail.
Replacement Tenant
The tenant has the right to propose a replacement tenant, who must be acceptable and solvent to the landlord. The landlord must explicitly agree to the replacement tenant. The replacement tenant enters into the contract under the existing conditions. The tenant and the replacement tenant are jointly liable for the rental fee.
Early Return or Cancellation
In the case of early return of the rental property or cancellation of the rental, the entire rental fee remains owed.
The landlord is not obligated to actively seek a replacement tenant in the event of contract cancellation or early return of the villa.
Force Majeure
In the event of force majeure (environmental disasters, natural forces, etc.), official measures, unforeseen or unavoidable events preventing the rental or its continuation, the landlord is entitled, but not obliged, to offer the tenant a comparable alternative property, excluding any claims for compensation. If the service cannot be fully provided, the paid amount or a corresponding portion for the unfulfilled services will be refunded, excluding any further claims.
Return of the Rental Property
Villa Serenity must be returned on time, on Sunday at 12:00 pm, in good condition with the inventory. The return of the rental property will be conducted through an inspection with the tenant and landlord to identify any damages incurred during the tenant’s stay. The tenant is liable for damages or missing inventory. Damages caused by staff are not the tenant's responsibility. Final cleaning is included in the rental price.
Tenant’s Liability
The tenant is liable for all damages caused by themselves or their household members, including guests, with fault presumed. If damages are discovered after the return of the rental property, the tenant is also liable for these if the landlord can prove that the tenant or their household members or guests caused the damages. The tenant or their household members and guests are solely liable for any accidents.
Landlord’s Liability
The landlord is responsible for a proper reservation and contractual fulfillment. The landlord’s liability is excluded to the extent permitted by law. Liability is particularly excluded for actions and omissions by the tenant (including household members and guests), unforeseeable or unavoidable omissions by third parties, force majeure, or events that the landlord, intermediary, or other persons employed by the landlord could not foresee or prevent despite due diligence.
Descriptions of infrastructure and tourist facilities such as swimming pools, public transport, tennis courts, mountain railways, slopes, shop hours, etc., are for informational purposes only and do not bind the landlord.
Data Protection
The landlord is subject to Swiss data protection laws and processes data according to these regulations. The landlord will process the data provided to them according to legal requirements and, if necessary, transmit it to the keyholder to fulfill the contract correctly.
The landlord may inform the tenant about their offers in the future. If the tenant does not wish to receive this service, they can contact the landlord directly. There will be a corresponding cancellation notice in the provided information. According to local legislation, the landlord or keyholder may be required to register the tenant and their household members with local authorities. The landlord reserves the right to transmit the tenant’s or their household members’ and guests’ data to relevant authorities or appoint third parties to enforce their rights for pursuing legitimate interests or in case of suspected criminal activity.

Applicable Law
Swiss law applies. The exclusive place of jurisdiction is Bäch, Canton of Schwyz. Mandatory legal provisions to the contrary remain reserved.
